What is Section 75?
While we're in the early stages of releasing our credit card out into the world, we'll be making our eligibility checks available in the app over the coming months – so keep your eyes peeled.
Even those who've had a credit card for years might not know much about what Section 75 is – the name itself can sound rather formal and intimidating. So let's break it down. Section 75 of the Consumer Credit Act makes it possible for credit card companies (like Chase) to refund a card holder (like you) for eligible transactions when there's an issue with the item, service or the service provider.
Here are a few scenarios when you might lean on Section 75:
- Your item never arrived
- The product or service was faulty or not as described
- Either of these two scenarios, plus the company that you bought the product or service from has gone out of business
What is covered by Section 75?
- An item costing over £100 but not more than £30,000. As an example, a transaction with two items that cost £80 each wouldn't be covered, but one item that costs £160 would
- Items you bought less than six years ago – though it could be longer if there’s a guarantee included in the purchase price that covers your product or service for longer, such as double glazing
- Store cards
- Foreign transactions as well as goods bought online, over the phone, in a shop or by mail order for delivery to the UK from overseas
What isn't covered by Section 75?
- Items that cost £100 or less or £30,000.01 or more
- Multiple single items that add up to between £100 and £30,000
- Purchases that weren't authorised by the card holder
- Purchases not made between an issuer and merchant (like through third-party sellers)
- Purchases made with cash you've withdrawn from a credit card
- Purchases made on a non-consumer credit card (like a business credit card)
- Hire purchases
- Delivery charges – if you bought a ticket for £95 and paid a £10 delivery fee, the purchase wouldn't be covered as the ticket itself was below £100
- Loans
- Balance transfers
- Purchases made by additional card holders
How do I make a Section 75 claim?
You can contact the service provider or retailer first to see if they can replace the item or issue you a refund. Alternatively, you can get in touch with us via 'Support' in the app to make a claim. Just so you know, you may be asked to provide detailed information and proof about the purchase.
